Consular protection. What to do if a relative (friend, acquaintance) dies abroad



Regulations on the procedure for assisting in the burial on the territory of the Republic of Uzbekistan of the deceased on the territory of a foreign state (in Russian)

Suppress grief and confusion as much as possible. Prepare to clearly state to the representatives of the consulate of the Republic of Uzbekistan abroad:

  • Who, when, under what circumstances died, where is the body and is there a person or organization in the host country that took care of it
  • Is the person insured with an insurance company

Decide firmly:

  • Are you morally and financially ready to conduct a medical autopsy of the deceased
  • Want to return his body for burial home, or cremate abroad and return the ashes to Uzbekistan
  • Do you have the material opportunity to go abroad to settle the necessary formalities

Formulate other questions and requests to the staff of the consular post abroad.

The consul takes measures to protect the property left after the death of a citizen of the Republic of Uzbekistan. If the remaining property, in whole or in part, consists of items subject to damage, as well as the excessive cost of keeping it, the consul has the right to sell this property and is obliged to send the proceeds to the property.

Why is all of the above necessary?

  • Every day a deceased person is found abroad is not only grief for you, but also a constant increase in the amount of the bill for morgue services (an annoying but important detail).
  • The necessary documentary work for you will be performed by the consular office of the Republic of Uzbekistan abroad, you need business constructive cooperation with it.
  • Due to the fact that opening the body, embalming it, positioning it in a zinc coffin, transportation - all this costs money, returning the body to its homeland is quite expensive (the cost varies depending on many circumstances).
  • If a person is insured and the insurance involves the payment of mourning expenses, then all or part of the payment will be borne by the insurance company, in which case you need to find out what documents it will need in order to notify the consular office of this.
  • The approximate cause of death of a person will be determined by the doctors of the host country; this reason can be entered into the "Death Act". To clarify the cause of death, an autopsy is required, but it will cost money. It will take some time to find out how much exactly, and without the consent of the relatives of the deceased, no steps will be taken (at least, they should not be taken), so the speed of this sorrowful process depends on you.
  • If the deceased had his passport, then the identity of the deceased will be established from the photograph on the passport (if there is reason to doubt the identity of the person, then its establishment is a separate long process).
  • If you are ready to leave for the body of the deceased, you will significantly speed up and facilitate the process of returning his body or ashes to their homeland.
  • If you are ready to pay the funeral expenses, you can count on a fairly quick return of the body to the Republic of Uzbekistan. If you do not have money, then the process can be delayed.

You have decided everything clearly for yourself. Now contact the consulate of the Republic of Uzbekistan in the host country, in the consular district of which the death occurred.

At this stage, you will need your notarized solutions:

  • About carrying out (or not carrying out) an autopsy
  • About consent to cremation or a decision to return the body to its homeland
  • If you carried out additional identification of the body, then you also need to confirm the identification of the person of the deceased
  • You can issue powers of attorney to specific people for certain actions if you cannot personally go to the place of death of your relative

The Consulate of the Republic of Uzbekistan abroad will take care of the preparation of the necessary documents on death and accompanying documents for the transportation of the coffin with the body of the deceased, therefore, perhaps as soon as possible, the following documents should be sent to the consulate:

If you have decided to cremate the body of a loved one or someone close to you, you will need to submit the following documents:

  • Original of his passport
  • Medical certificate of death issued by a doctor or medical institution with a mandatory doctor's signature and seal (issued by a medical or forensic medical institution of the host country)
  • Other documents, if you need to get their notarized translation or notarized copies at the consulate

If you have decided to export the coffin with the body of the deceased to your homeland, then you will need:

  • Original of his passport
  • Medical certificate of death issued by a doctor or medical institution with a mandatory doctor's signature and seal
  • Certificate of the position of the body in the coffin
  • Certificate of body embalming and the composition of the embalming solution
  • Permission of the quarantine inspection of the host country to export the coffin with the body of the deceased
  • Other documents, if you need to get their notarized translation or notarized copies at the consulate

If the body of a loved one or a person close to you was cremated, then at the consulate you will be given:

  • Death certificate
  • If the passport of the deceased is not sent by the consulate to the Ministry of Foreign Affairs of the Republic of Uzbekistan, then it can be returned to you with the appropriate cancellation marks

All consular and notarial actions for registration of death are carried out free of charge. Therefore, if you need some notarized copies of the above documents, you can ask the consulate to issue them for you.

Due to the fact that the urn with the ashes of the deceased is not epidemiologically dangerous, does not take up much space, is not airtight, in principle it is not sealed. in this case, for its transportation across the border, no other documents are required, and when crossing the border, it can be inspected by customs. If you want the urn to be sealed, then ask the consul to close it, seal it and give you a certificate of the absence of foreign objects.

If you take out the body of a loved one or someone close to you in a coffin, then the consulate will give you:

  • Death certificate
  • The passport of the deceased with appropriate cancellation marks
  • A certificate of the position of the body in the coffin with a notarized translation into Russian
  • Certificate of body embalming and the composition of the embalming solution with a notarized translation into Russian
  • Permission of the quarantine inspection for the removal of the coffin with the body of the deceased with a notarized translation into Russian
  • A certified copy of the deceased's passport for customs and a notarized copy of the death certificate for the customs of the Republic of Uzbekistan
  • Certificate of the consulate about the absence of foreign objects inside the coffin
  • Other documents, if you need to get their notarized translation or notarized copies at the consulate

Citizens of the Republic of Uzbekistan, legal entities can always receive full protection of their rights and interests by consular institutions of the Republic of Uzbekistan abroad. A consular officer is obliged to take measures to ensure that citizens and legal entities of the Republic of Uzbekistan enjoy all the rights granted to them by international treaties to which the Republic of Uzbekistan and the host state of the consular post are parties, international customs, as well as the legislation of the host state of the consular post, if such rights do not contradict the legislation of the Republic of Uzbekistan (Article 15 of the Consular Charter of the Republic of Uzbekistan No.ZRU-517 dated January 17, 2019)
